END-USER LICENSE AGREEMENT FOR IRC SOFTWARE

* IMPORTANT-READ CAREFULLY *
This IRC End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Inter-Register Communications (M) Sdn. Bhd. for the IRC software product identified above, which includes computer software and may include associated media, printed materials, reports, and "online" or electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE"). Any software provided along with the SOFTWARE PRODUCT that is associated with a separate end-user license agreement is licensed to you under the terms of that license agreement. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you may not use the SOFTWARE PRODUCT. For purposes of this EULA the term "IRC" shall include Inter-Register Communications (M) Sdn. Bhd., its affiliates, suppliers and distributors.

* SOFTWARE PRODUCT LICENSE *
This software and related instruction material has been developed and distributed by IRC. This software and related instruction material may not be copied,  altered, decompiled, reverse engineered, attempt to discover the source code of the software or in any way changed without the prior written consent of IRC.

* NO WARRANTIES *
IRC does not make any warranty, express or implied, of this software or related instruction material as to  merchantability, fitness for any particular use or purpose, or reliability of use. No warranties of any kind are made, expressed or implied, and no individual or corporation whatsoever may do otherwise.

In no event will IRC be liable for any direct, indirect or consequential damages whatsoever or for any problems resulting from the use of this software and related instruction materials.

* LIMITATION OF LIABILITY *
To the maximum extent permitted by applicable law, in no event shall IRC or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software product or the provision of or failure to provide support services, even if IRC has been advised of the possibility of such damages.

In any case, IRC's entire liability under any provision of this eula shall be limited to the greater of the amount actually paid by you for the software product or US$5.00; provided however, if you have entered into a IRC support services agreement, IRC's entire liability regarding support services shall be governed by the terms of that agreement. Some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages. Accordingly, the above exclusion or limitation may not apply to you.

* TERMS OF USE *
a) Not to use or rely on the software whatsoever related thereto for "mission critical" applications. "Mission critical" applications shall mean applications that may result in damage if failed.

b) You acknowledge and agree that IRC may gather information and usage pattern, and as well as registration parameters provided by you, your software and configuration, provided that if published, it will be done only in aggregate form without user names.

c) You agree that IRC may use this information provided by you and the Software, or information related to, for the purpose of target advertising, marketing, co-registration to other services by IRC or other parties, provided that if names are part of this information you had been given the advanced opportunity for omission of your name.

d) Comply with any legal obligations, including but not limited to, obligations imposed by copyright, trademarks, patent, secrecy, defamation, decency, privacy and export laws.

e) IRC may use your name in any customer reference list or any other release issued by IRC or any of its affiliates.

f) You expressly agree to accept and receive information about products, services, news and events in any mean, including without limitation by email.

g) You agree that IRC is permitted to limit, disable, eliminate or cancel some or all of the functionality of the Software.

h) The user is strongly advised to backup his data daily.

i) You as the user may not copy, or reproduce in any manner whatsoever this software and related instruction material.
